1. Acceptance of Terms

By accessing or using this website and placing an order, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the site.

  • You may be required to check a consent box at checkout (WooCommerce’s “Terms” checkbox). Your order will not process without that consent.
  • Our Privacy Policy and Refund & Returns Policy form part of these Terms and are incorporated by reference.

2. Eligibility

You must be of legal age to enter into a binding contract in your jurisdiction. If you buy on behalf of a company, you represent that you have authority to bind that company.

3. Account, Accuracy & Security

  • You are responsible for maintaining your account credentials and restricting access to your devices.
  • You agree to provide accurate, complete, and current information during checkout and to update it as needed.

4. Products & Formats

We sell:

  • Digital e‑books (e.g., EPUB, PDF)*
  • Print‑on‑Demand books fulfilled by third‑party printers (e.g., Lulu, Amazon KDP)**
  • Stocked inventory paperbacks, including signed editions fulfilled directly by us (while supplies last)

Product descriptions, images, and availability are provided in good faith but may be updated without notice. Minor variations in paper, print color, or finish can occur with POD.

5. Pricing, Taxes & Currency

  • Prices are listed in Canadian Dollars (unless otherwise indicated) and may change at any time.
  • At checkout, applicable taxes (e.g., sales tax/HST/GST/VAT) and shipping fees are calculated based on your shipping address.
  • You are responsible for any customs, duties, and import taxes for international shipments.

6. Orders & Acceptance

  • Placing an order is an offer to buy. We may accept or decline for any reason (e.g., suspected fraud, pricing error, stock unavailability).
  • Once accepted, you will receive an order confirmation by email.
  • We reserve the right to limit quantities per customer or per order.

7. Payment

We accept payment methods shown at checkout (e.g., credit card, PayPal/Stripe). You authorize us and our payment processor(s) to charge your selected method for the order total.

8. Shipping & Delivery (Physical Books)

  • Stocked/signed paperbacks ship from our location. Refer to our Shipping & Returns Policy for further details.
  • POD books are printed and shipped by third‑party providers. Processing times and delivery windows vary by region and carrier.
  • Risk of loss passes to you upon delivery to the carrier. Title passes upon full payment.

Delays & Issues: We are not liable for delays due to carriers, customs, weather, or events beyond our control. If your book arrives damaged or defective, contact us within 7 of delivery with photos and your order number.

9. Digital Downloads (E‑Books)

  • After successful payment, you will receive a download link via email and/or your account.
  • Download window/limits: Link valid for 90 days, up to total of 5 downloads.*
  • File formats: EPUB.
  • DRM / watermarking: DRM-free*.

*E‑Book License:
When you purchase a digital e‑book, you are granted a non‑exclusive, non‑transferable license for personal use only. You may not share, resell, upload, distribute, or make the file available publicly. Any unauthorized distribution may result in license termination and potential legal action.

10. Returns, Refunds & Exchanges

  • Digital e‑books:

    • All sales are final once the download link is delivered and/or accessed. No refunds for digital content except where required by law or in cases of download failure we cannot resolve.

    POD books:

    • POD items are printed to order and are generally non‑returnable unless defective or damaged. Please contact us within 7 days with photos and your order number.

    Stocked/signed paperbacks:

    • Signed editions are non‑returnable unless damaged in transit.
    • Un‑signed stocked items may be returned within 14 days of delivery if unused and in original condition. Return shipping is your responsibility unless the item is defective or we shipped the wrong item.
    • To start a return, contact author@aaronbabcock.ca with your order number.
    • Refunds (if approved) will be issued to the original payment method minus shipping/handling. We may reject returns that do not meet policy requirements.

    Summary:

    • Returns are accepted within 14 days of delivery.
    • Item must be in original condition (unread, undamaged).
    • Signed or personalized books are non-refundable.

11. Third‑Party Services (POD & Payment)

We use third‑party providers for printing, payment processing, shipping, and analytics. Your use of those services may be subject to their terms and privacy policies. We are not responsible for third‑party acts or omissions.

12. Promotions & Discount Codes

Promo codes must be used within their validity window, cannot be combined unless stated, and may be limited to certain products or regions. We may modify or discontinue promotions at any time.

13. Intellectual Property

All content on this site—including books, text, images, logos, branding, and design—is protected by copyright and other laws. You agree not to reproduce, distribute, or create derivative works without our prior written permission, except as permitted under the e‑book license for personal use.

14. User Reviews & Submissions

If you submit reviews or comments, you grant us a worldwide, royalty‑free license to use, reproduce, and display that content in connection with the site and our marketing. You agree not to post unlawful, defamatory, or infringing content. We may moderate or remove submissions at our discretion.

15. Prohibited Uses

You may not use the site to:

  • Violate any law or infringe intellectual property rights
  • Attempt to breach site security or compromise other accounts
  • Engage in fraudulent, misleading, or harmful activity
  • Reverse engineer or interfere with site operation
  • Circumvent digital rights management or watermarking protections

16. Warranties & Disclaimers

Except as expressly stated, products and the site are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

17. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill) arising from or related to your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

18. Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the site or products.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of Nova Scotia, Canada.

  • Venue: Courts located in Halifax, Nova Scotia will have exclusive jurisdiction.
  • Informal resolution: Contact us first to attempt to resolve any disputes within 30 days.

20. Privacy

Your use of the site is subject to our Privacy Policy. We process personal data in accordance with applicable laws.

21. Changes to the Terms

We may update these Terms at any time. The “Effective Date” will reflect the latest revision. Continued use of the site after changes means you accept the updated Terms.
